If you are already a Professional Client of HFS, this update of the terms and conditions will apply to you 15 days after you have been notified of the change.

We want to bring you clarity and transparency about HFS. We know that legal texts are important, although cumbersome. To make it easier for you, we briefly tell you who we are, what services we can offer you and what you can or cannot do:
About us?
HFS (HFS, S.A.U., our legal name) is the company that manages this Website and Apps. Our headquarters are in Madrid, in Plaza de las Cortes (yes, next to the famous lions). We are registered in the Mercantile Registry of Madrid and we have NIF.
What services do we offer?
We provide you with a space so that you can publish, or search, advertisements for the sale or rental of real estate, be it an apartment, a room in a shared apartment or a garage, to give you a few examples. We also offer you other services related to the real estate sector, such as property valuations or the energy certification service, to give you a complete experience.
What can and can’t you do in HFS?
You can browse the Web and Apps, register to save searches and favourites, contact advertisers, publish properties for sale or rent, as well as contract other additional services.
You may not harm third parties or HFS, do acts contrary to the law, use automatic mechanisms to copy or extract our content, make fraudulent contacts or use the access codes of other users without their permission.
If you are an advertiser, we recommend that you also read our publishing guidelines carefully.
Who is the owner of the content of the Web and Apps?
HFS is the owner of all the content, images, brands, logos, videos, texts, etc. that appear on the Web and Apps (or belong to third parties that have given us their permission). In addition, by sharing material on HFS, you authorize us to continue using it even after your ad has been removed, for our price reports or historical references of the real estate market or for the HFS/maps service, for example.

From HFS, S.A.U. (hereinafter, “HFS”, “us” or “we”), we put at your disposal these terms and conditions (hereinafter, the “General Conditions”) that regulate:

Our website, hosted under the domain www.HFS.com and its subdomains, contains a technological platform that we make available to our users so that they can publish advertisements for the sale or rental of real estate, or search for a property (hereinafter, the ” Main Services”).
HFS is limited to facilitating contact between those users who offer a property and those who are looking for it. We do not intervene in transactions that may arise from such contacts. We are not a real estate agency nor are we dedicated to the sale and/or rental of real estate. In this context, we offer some related additional services (hereinafter, the “Additional Services” and together with the “Main Services”, the “Services”). You can obtain more information about our Additional Services in clause 7 of these General Conditions.

2. Access and Acceptance of the General Conditions
By accessing or using the Web and Apps, you do so under your sole and exclusive responsibility, granting you the status of user (hereinafter, “User” or “Users”) and it assumes that you have read, understand and expressly agree to comply unreservedly with these General Conditions. in the version published at any time. In the event that you use Services that require registration, both privately and professionally, you will become a registered user (hereinafter, “Registered User” or “Registered Users”), and it will also mean that you accept the particular conditions that may replace, complete, and/or modify these General Conditions (hereinafter, the “Particular Conditions”), as applicable in each case.
At any time we reserve the right to extend, modify, substitute and/or cancel our Services and/or these General Conditions, without prior notice and without giving rise to any liability or compensation on the part of HFS. We will do our best to notify you of any modification that the General Conditions may suffer. In particular, if you are a Registered User, we will notify you of any modification of the General Conditions by email to the email address that you have provided us during your registration. We will also update the “date of last update” located in the upper zone of these General Conditions. However, we advise you to frequently review these General Conditions to be aware of any changes we may have made.
If you access the Web and Apps or use the Services after any change in the General Conditions is made, you will be expressly accepting the new General Conditions.
If you do not agree with these General Conditions or with any modification that may be made to them, you must stop using the Web and Apps or the Services. If you continue using them, you will be accepting the General Conditions.
For clarification purposes, these General Conditions and the Particular Conditions, where appropriate, will apply to both private Users and professionals.

The Services offered by HFS are not directed to persons under 18 years of age. By accessing or using our Website and Apps or Services, you declare and guarantee that you are over 18 years of age.
4. Conditions of use and responsibility for the use of the Web and Apps
The use you make of the Web and Apps must respect these General Conditions, and, where appropriate, the Particular Conditions, the law in force at any time, morality, good customs and public order.

You can not:
Enter, share, broadcast or publish:
Content of a racist, xenophobic, obscene or denigrating nature.
Content that encourages criminal, terrorist, violent or defamatory acts based on age, sex, religious beliefs or of any kind.
Content that infringes the fundamental rights of third parties in any way.
Information that constitutes illegal or unfair advertising.
Content that violates the secrecy of communications and/or the applicable regulations on the protection of personal data.
False, inaccurate or fraudulent content that may mislead the recipients of such information.
Use the Web and Apps for illegal purposes, nor for resale, transfer or provision for the use or benefit of any other person or entity.
Cause damage to the computer systems of HFS or third parties, nor introduce or spread computer viruses or any other type of harmful system that may cause damage to computer systems.
Carry out acts that entail an infringement of our intellectual property rights and/or damage to the reputation of HFS or third parties.
Using the identity and/or access codes or password of a third Registered User without their consent.
Access, control or copy any information included in this Website and Apps using any type of robot, spider, scraper or other automatic means or manual process for any purpose, without our express written permission.
Violate the restrictions of the robot exclusion notices included in this Website and Apps, as well as bypass or circumvent other measures used to prevent or limit access to this Website and Apps.
Take any action that imposes or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.
Establish a link to any content on this Website and Apps for any purpose and without our express written permission.
Replicate, reflect or in any way incorporate any content from this Website and Apps on any other website without our prior written authorization.
What happens if you do any of these actions?
If you carry out any of these conducts, you will be liable for any damages that may arise as a result of a direct or indirect breach of these General Conditions or the Particular Conditions, and you agree to hold HFS harmless. 5. Publication of announcements
In order to offer your property on our Web and Apps by publishing an ad, you must register. By doing so, you guarantee that all the information you include in the ad is true, exact and up-to-date. From HFS we will endeavor to verify the veracity and accuracy of the data published in the ads, but we cannot fully guarantee the veracity of the data. Therefore, you agree to keep the data updated at all times, notifying us as quickly as possible in the event that any data is out of date or inaccurate.
By publishing an advertisement, you acknowledge being the sole owner of the property you advertise (or being duly authorized by the owner or the other co-owners of the property for its publication) and you will be solely responsible for the veracity of the published data, for which you will exclusively assume any liability or damage that may arise in this regard. In addition, in the case of contracting multimedia services, you expressly state that you have sufficient representation to authorize HFS to take images of the properties. Likewise, you acknowledge and accept that, in any case, you will hold HFS harmless against any claim that may arise, directly or indirectly, in relation to the taking and recording of images by HFS and their subsequent publication.
HFS has no more responsibility than that described in these General Conditions and in the applicable regulations. The price and other information that appears for each ad in relation to the properties offered on the Web and Apps does not constitute a commercial offer on our part.
Do not publish repeated images or with any type of frame, watermark, logo or text or compositions of several images of the properties.
Do not publish ads without images or with images that are not relevant to the ad (such as, for example, empty images, monuments, tourist or commercial areas in the area of the property, animals or people).
Do not publish properties of a different type from the one contracted (new construction / second hand).
Do not publish properties under a type of operation other than the one contracted (sale / rental).
Do not publish more than one ad for the same property simultaneously or give repeated registrations and cancellations of the same property whose market situation has not changed.
Indicate if you publish a property under the co-ownership modality, in which case you must also have a specific publication agreement under this modality signed with HFS.
Do not add more contact numbers than those allowed for the type of package contracted.
Do not add telephone numbers or additional contact emails outside the space designated for that purpose in the ad.
Limit the number of logins to the maximum established according to the type of package contracted.
Do not publish properties in areas other than the contracted area.
Provide a single business address for the publication of real estate. In case of having multiple business addresses, it will be necessary to hire a publication package for each business address to be used.
Do not publish properties that will not be available in the short term, not announcing properties that are reserved or rented.
Do not publish properties for vacation rental or tourist use.
Do not label a photo in the ad as “plan” if it does not correspond to a plan.
To insert the exact address to correctly geoposition the property, even with the “hide address” functionality activated. Keep in mind that this optional functionality of “hiding address” will entail a cost, if you are a Private Advertiser, which will be specified to you at the time of publishing the ad.
Do not publish inaccurate prices (such as, for example, indicating that the price includes a garage and adding the additional price of the same in the description of the property).
Specify the energy class, accompanying it with an image of the “energy certificate” that certifies that the property has the certificate.
Include in the advertisements any information that may be mandatory in accordance with current state, regional or local regulations, which may be applicable at all times.
You acknowledge that HFS reserves the right to (i) apply penalties on the publication of advertisements; or (ii) cancel the advertisements that do not comply with these publication rules or the General Conditions and/or the Particular Conditions, if applicable.
anti-fraud measures
In order to prevent fraudulent use of the Services, you acknowledge and accept that HFS may quarantine those advertisements that contain material suspected of being fraudulent or contrary to these General Conditions. Quarantined ads will not be visible on the Web and Apps until their legality is verified.
HFS will have the right, but not the obligation, to investigate all fraud incidents reported by Users and, in such case, the advertiser must collaborate to carry out such investigation.
By using the publication service, you acknowledge and accept that HFS will not be liable for direct or indirect losses and damages related to the fraudulent use of the Services and, in particular, with the application of anti-fraud mechanisms and measures, which includes, without limitation some:
loss of income or profit;
loss of business;
loss of benefits or contracts; Y
data loss.
HFS reserves the right to implement any other anti-fraud measures it deems appropriate or necessary at any time.
By these General Conditions, you accept that when the ad has been published with your consent, at the end of the publication process, you will lose the right of withdrawal, based on the provisions of article 103.m) of Royal Legislative Decree 1/2007 , of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users (if said precept is applicable).
For clarification purposes, these publication rules will apply to both Private Advertisers and Professional Clients who publish on the Web and Apps.
7. Additional services
As we anticipated at the beginning of these General Conditions, apart from the use of the Web and Apps and the Main Services that allow connecting people who offer and search for real estate through the publication of advertisements, we also offer a series of Additional Services, which we can lend directly to us or another

Mortgage brokerage service provided by HFS, Crédito y Financiación, S.L (HFS/mortgages). Consult the terms and conditions of this service.

Opportunities aimed at professionals interested in collaborating in the real estate credit intermediation activity of HFS/mortgages or in the insurance mediation activity carried out by HFS/insurance.

Real estate valuation service (these are not official appraisals).

Sending information about similar properties that may be of interest to you.
API service.

Advanced electronic signature service, either through HFS or a collaborating third party (Signaturit), in the following cases:
Rental contract creation and signing service. You can consult the specific terms and conditions of this service.
Making available to Professional Clients, through HFS/tools, the advanced electronic signature service for their own clients, of certain documentation related to the sale or rental of real estate. Professional Clients will be exclusively responsible for the content of said documentation, as well as the data of clients or third parties that they provide, where appropriate, for this service.
Multimedia services that help you improve your ad (photo book, video or virtual tour).
Support service to help you sell or rent your property, which allows contact between owners with a property for sale or rent and professional advertisers who can help you sell or rent your property. By making use of this support service (whether as an owner or as a professional advertiser), you acknowledge and accept that the property to be marketed by the selected professional must be advertised preferably on HFS.
Duplicate service (DeDup), to identify duplicate ads from various sources on the Internet. It is a search engine that allows you to group ads published on various web pages or web applications that refer to the same property. With this service, basic public data is shown and the different advertisements found for a certain property are linked, which can be accessed to obtain more detail.
Keep in mind that these Additional Services may be subject to Particular Conditions that are different from these General Conditions.
8. Intellectual and Industrial Property
8.1. Materials and information contained in the Web and Apps
By these General Conditions, you acknowledge and accept that all rights to the materials and elements that appear on the Web and Apps (including, without limitation, drawings, texts, graphics, maps, photographs, images, audio, video, distinctive signs , logos, trademarks, trade names, domains, software, etc.) belong to HFS, or, where appropriate, to third parties that have consented to their transfer to HFS, so we have all the rights and licenses necessary for their use.
The fact that we allow you to access, use, navigate, use and/or download materials from our Website and Apps in no way implies that we waive, or that we are transferring or granting a license or assignment of our rights, nor that you acquire ownership over them. themselves. As a User, or as a Registered User, you only have a strictly personal and private right of use, exclusively for the purpose of enjoying the Service. Consequently, you cannot manipulate any element of identification of HFS or of the respective holders. 8.2. Material published on the Web and Apps
The materials and information that you publish on our Website and Apps when using the Services must respect the image and intellectual and industrial property rights that may exist on them.
By disseminating or publishing information, non-personal data, photographs or any other material with us, you grant us a license with effect throughout the world, for the maximum term of protection permitted by law and with the possibility of sublicensing that information to associated companies and third parties.
In particular, you authorize:
Add HFS watermarks in order to prevent those photographs from being published by unauthorized third parties.
Use the information about the properties advertised on our Website and Apps to carry out property valuations and appraisals, price reports, statistical reports, historical references or others in the real estate market. Said information may be used even after the respective advertisements have been removed from the Web and Apps.
To the distribution, reproduction, transformation and public communication of that material.
Likewise, if you are a photographer and you use and/or access our Website and Apps to upload photos, videos and house plans that are the result of your work or service, by disseminating or publishing information, non-personal data, photographs or any other material through HFS, you grant us a license with effect throughout the world, during the maximum term of protection allowed by law and with the possibility of sub-licensing that information to associated companies and third parties. In this sense, you acknowledge that HFS has the right to disseminate all or part of the content of the advertisements for advertising campaigns, promotion of the Web and Apps, blogs, etc.
8.3. Material contained and stored in HFS/tools
All rights to the materials and elements appearing in the HFS/tools software belong and shall remain with HFS or its third party licensors (as applicable). Nothing in the General Conditions or Particular Conditions can be interpreted as an assignment in favor of Professional Clients of any image, intellectual or industrial property rights over the aforementioned materials and elements of HFS.
All rights to the information stored by Professional Clients in HFS/tools will continue to belong to them, or to their respective third-party licensors.
Notwithstanding the foregoing, by using the HFS/tools software, you grant a worldwide, non-exclusive, irrevocable, royalty-free, transferable and sublicensable license to HFS to use, copy, store, archive, modify, extract, display , distribute, transmit, transfer, make available, reuse, download and create, among other things, derivative works and data, from any non-personal information you have stored on HFS/tools, in order to:
(a) provide you with the Services that you have contracted from us; Y
(b) optimize, adjust, aggregate, evaluate, analyze, report and obtain information to improve and develop our Services, as well as any other service, product or technology that HFS provides or may develop and provide, provided that HFS does not disclose any information that identifies or can reasonably be expected to identify any party outside of HFS, Professional Client, its brands or its own clients.
Nothing in this clause affects the obligations of HFS regarding the protection of personal data, in accordance with the provisions of the Privacy Policy.
8.4. License Grant for HFS/maps
Without prejudice to the provisions of section 8.2 above, by disseminating or publishing information, non-personal data, photographs or any other material through HFS, you also grant us, with specific reference to www.HFS.com/maps (hereinafter , “HFS/maps”), a license with effect throughout the world, for the maximum term of protection allowed by law and with the possibility of sub-licensing that information to associated companies and third parties. In this sense, you acknowledge that HFS has the right to disseminate and use all or part of the content of the advertisements (prices, photographs, etc.), in order to allow the operation and improvement of the HFS/maps service. You also acknowledge that this information can be used even after the ads have been removed from the Web and Apps, authorizing us to distribute, reproduce, transform and publicly communicate this material on HFS/maps.
For clarification purposes, we inform you that HFS/maps shows publicly accessible data of all the properties that are registered in the Cadastre of Spain, regardless of whether or not they are advertised in HFS. The information that appears in HFS/maps comes, therefore, from the public cadastral information and also, if the properties have been published in HFS, from the public and non-personal data that appear in the corresponding advertisements. In short, the information from HFS/maps is obtained only from public sources, such as the Cadastre, and from non-personal data from advertisements published on HFS (in no case are personal data shown that allow the identification of the owners or occupants of the dwelling). .
Keep in mind that the price that may appear on HFS/maps for a certain property will be the one for which it was advertised on HFS and may or may not coincide with the final price for which it was sold or rented. In addition, the valuations shown are mere estimates obtained by HFS from the official data of the Cadastre. Said valuations should not be considered as an official appraisal and may not substitute in any case the valuation of a professional.
Finally, remember that the fact that a property is visible on HFS/maps does not imply that it has been or is available for sale or rent. If any property is available, we will inform you specifically.
9. Liability of HFS
Our responsibility is legally established by Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, which indicates that, in general, we cannot be responsible for the information published at the request of the users.
Although we put our best efforts to ensure that the published content is correct, we have no obligation to exercise prior control over the veracity, accuracy, legality, relevance or adequacy of the materials published on the Web and Apps since it is stored at the request of the Users. However, in the event of detecting or suspecting any illegal act or act contrary to these General Conditions or the Particular Conditions, we will act with due diligence to remove the affected information or make it impossible to access it in accordance with current regulations.
HFS will not assume any type of responsibility for damages or prejudices that could be derived from the relationship between Users due to their contacts or negotiations.
The Additional Services will be regulated in accordance with their Particular Conditions, assuming HFS, in relation to them, the responsibility that corresponds legally or contractually. In relation to the advanced electronic signature service, HFS will not be responsible in any case for documents not suitable for signing, uploaded, published or sent to other recipients by Users; or that have not been signed in a valid and/or adequate manner, in accordance with the criteria established in the applicable regulations and in these General Conditions.
The access and use of the Web and Apps requires a computer device or equipment and an Internet connection, so you accept that the associated expenses will be borne by you.
We are not responsible for the existence of any charge, encumbrance, right, conflict, mortgage, incident, embargo or census that could affect the properties advertised on our Website and Apps, and you agree to hold HFS harmless from any liability or damage in this regard.
We are not responsible for the accuracy, integrity, veracity, legality or adequacy of the information, materials and/or content available on third-party websites that you can access through the links available on our Website and Apps.
10. Payment methods on the Web and Apps
On the Web and App you can contract some of our Services, such as the publication of your properties if you are a Private Advertiser, and pay them directly by credit or debit card (Visa, MasterCard, American Express, etc.) or even with Bizum in certain cases. These means of payment are subject to verification and authorization by the corresponding issuing entities (issuers of the cards or payment accounts), therefore, if said entities do not authorize the payment, HFS will not continue with the transaction, which would be automatically cancelled.
To make the payment by credit or debit card, HFS has installed an electronic commerce payment gateway provided by authorized banking entities. All data provided to HFS for this purpose is duly encrypted to guarantee maximum security and confidentiality, and is hosted on a secure server certified according to the “Secure Socket Layer” (SSL) protocol.
11. Contracting with third parties through the Web and Apps
You acknowledge and accept that any contractual or non-contractual relationship that you formalize with any advertiser, User, Registered User or third party through our Web and Apps or our Services, will be carried out solely and exclusively between you. HFS will not be part of, nor will it assume any responsibility for, damages or losses that may arise from this relationship.
Therefore, we recommend that you act with caution when contacting or contracting with any advertiser, User, Registered User or third party through our Website and Apps. If you have any doubts or suspicions that any illegal activity, fraud or conduct contrary to these General Conditions is being carried out, we advise you not to formalize any payment or contract and to contact us (from the “Have you seen an error” available in the ads) as soon as you detect it. We will do our best to help you solve it.
12. Links or hyperlinks to the Web and Apps
From HFS we care about the integrity of this Website and Apps when accessing or viewing it from any area created exclusively by third parties. In this sense, you must request the express written permission of HFS before deep linking or framing this Website or any of its contents. If you wish to do so, when contacting HFS to request permission you must include: a) name, email address and telephone number, b) the name of your company, c) the address(es) of the website where the proposal will appear deep-link or frame-link and d) specific details of the deep-link or frame-link being contemplated, including the content or pages of the website to which you wish to deep-link or frame-link.

Access to the Web and Apps and the Services have, in principle, an indefinite duration.
Both the User and HFS can terminate the relationship, without prior notice.
However, a different duration and the need for prior notice may be established for any case in the Particular Conditions, in the contract signed by professional advertisers or in the applicable legislation. Any clause of these General Conditions that is or becomes illegal, invalid or unenforceable will be excluded, being replaced by another that is as similar as possible, without affecting the User, and without giving rise to any compensation. In this case, the rest of the provisions or sections will not be affected.
15. Applicable Law and Jurisdiction
These General Conditions are subject to the laws of Spain. Any conflict that may arise will be submitted and resolved by the Courts and Tribunals of the city of Madrid, or by those of the User’s domicile.
